STANDARD CONTRACT TERMS AND CONDITIONS
Our Policy Statement
IT IS THE POLICY OF DAY2DAY ELECTRICALS LTD TO OFFER THE VERY BEST SERVICE POSSIBLE.
IT IS OUR WISH TO MAKE ABSOLUTELY CLEAR OUR STATEMENT OF INTENT TO THE CUSTOMER.
IF ANY CONDITIONS OF OUR QUOTATION OR SPECIFICATIONS ARE NOT ENTIRELY CLEAR THE CLIENT IS ASKED TO RAISE THIS IMMEDITAELY IN ORDER THAT WE MAY DEAL WITH IT APPROPRIATELY AND WITH ALL HASTE.
1.0 Definitions
1.1 In these Conditions the following words and expressions shall have the following meanings: ‘The Client’ being xxxxxxx ‘Quotation’ includes any quote, estimate or specifications given by day2day electricals ltd
2.0 Application
2.1 Unless otherwise specifically agreed in writing and signed by or on behalf of day2day electricals ltd these conditions shall be incorporated in every offer, quotation, order and acknowledgement of order for the sale or supply of goods or services by day2day electricals ltd and any conditions proposed by the client are hereby excluded unless specifically agreed in writing
3.0 Acceptance
3.1 Unless previously withdrawn the quotation is available for acceptance for a period of 90 days from the date of such quotation
3.2 All quotations given by day2day electricals ltd are deemed to be accepted when day2day electricals ltd are asked in writing or by verbal agreement to start work and thereupon a contract shall exist. In the case of contracts signed in the home or place of work of the Client, a cancellation period may apply and if this is the case the Client will be given a Notice of the Right to Cancel
3.3 Each quotation when accepted by the Client constitutes a separate contract
3.4 By inviting to commence work the client confirms that they have had notice of and accept these terms and conditions
4.0 Terms of Payment
4.1 Payment of 30% of the final invoice will be required on order of the equipment.
4.2 The remaining balance will be required on completion of installation. Any commissioning information required for eligibility for FIT will not be surrended until payment has been received in full
4.3 Day2day electricals ltd reserve the right to submit interim invoices for work carried out or in progress with a final invoice on completion of work
4.4 Where the contract is deemed particularly large day2day electricals ltd require several interim invoices as previously agreed
4.5 Day2day electricals ltd reserve the right to request payment in full in respect of materials required before work is commenced
4.6 Day2day electricals ltd shall be entitled to charge interest at the fixed rate of 2.5% per month on all sums due and unpaid
4.7 Day2day electricals ltd may wish to carry out credit checks against the client
4.8 All prices are inclusive of VAT unless otherwise stated, and prices quoted to Clients who are private consumers will always be inclusive of VAT
4.10 Any electrical certification which day2day electricals ltd provide, will not be surrendered until full payment has been received.
5.0 Time is not of the essence
5.1 The dates or periods suggested by day2day electricals ltd for completion of works or delivery of materials are not the essence of the Contract and is at best Quotation based upon current commitments and conditions.
5.2 Day2day electricals ltd will always try to start works on the day that has been mutually agreed. Sometimes, these dates have to be rearranged and day2day electricals ltd reserves the right to do so
6.0 Property
6.1The risk of any loss to or damage to or deterioration of goods supplied by day2day electricals ltd (and whether or not to be attached to or in any construction or installation) from whatever cause arising shall be borne by the Client as and from the date of due payment as specified in these conditions
6.2 The legal and beneficial ownership of the goods shall not pass to the Client until payment in full of all sums due and owing by the Client to day2day electricals ltd in respect of goods
7.0 Warranty
7.1 day2day electricals ltd shall at its own cost repair, make good or at it’s opinion replace any materials supplied that are defective due to defects in design within a reasonable period from the date of delivery except where:
- The client has not as soon as reasonably practicable after becoming aware of the defect informed day2day electricals ltd in writing of its existence
- The client has not paid in full all invoices delivered prior to the date of such written notice and due for immediate payment
- The client permits other persons not approved or authorised by day2day electricals ltd to effect any replacement or materials as referred to in day2day electricals ltd Customer Charter
- The client has not complied, in a material respect, with any reasonable instructions or other directions given by day2day electricals
- The liability of day2day electricals ltd shall not extend to any loss or damage suffered by the client due to causes beyond the control of day2day electricals
- No liability can be accepted for defects in goods supplied by day2day electricals ltd where they are used outside the limits of the specifications under which they were sold or mistreated or where incorrect decorative products are used
8.0 Termination
8.1If day2day electricals ltd receive information from which it appears that the Client may be unable to pay its debts day2day electricals ltd electrical shall be entitled to demand security prior to delivery either by payment in cash or by a bank guarantee notwithstanding any terms of payment previously agreed and in the event that the Client is unable to provide such security day2day electricals ltd shall be entitled to withdraw from the Contract without liability
9.0 Governing Law
9.1 The Contract shall be governed by and construed in accordance with English Law
